Toronto Slip-and-Fall Injury Lawyer

A “slip-and-fall” does not sound very serious. However, at Bougadis, Chang LLP Barristers, we have seen that while most cause only simple fractures and scrapes, some may result in:

These injuries may take a long time to heal; some may never heal completely.

The owner or manager of every public or private property has a responsibility to keep it reasonably safe pursuant to the Occupier’s Liability Act. This includes: keeping sidewalks and outside steps free of ice and snow; keeping stairs and railings in good repair; maintaining lighting; and dealing with other hazards like wet floors and winter mats, exposed electrical wires or heavy objects on high shelves.

If you have been injured on property that was not properly maintained, you may be able to obtain compensation for your injuries.

It is vitally important to act quickly, however, especially if your accident happened on municipal property in Ontario. The City or municipality requires written notice of your claim within ten (10) days of your accident. If you fail to do so, even if you are in the hospital during that time, the City or municipality can dismiss your claim pursuant to the Municipal Act.

Injuries on private property allow for up to two (2) years before a claim must be issued in Court pursuant to the Limitation of Actions Act. However, the longer you wait, the harder it is to prove your claim. It is also sometimes possible to mistake public property for private. It is always important to consult a lawyer and, when necessary file quickly.
