Insurance Coverage Reviewed
When an accident arises, a preliminary issue to be considered is whether there is insurance coverage available to the parties that may be responsible for the accident.
That is, if you sue for loss and damage, will the defendants in your lawsuit have an insurance policy to respond to your lawsuit?
Home Buyers Who Face a Defective New Home. What happens if you buy a new home which suffers from “significant water damage causing rot, infestation and deterioration”? If you sue the builder, will that builder have an insurance policy to respond to your lawsuit? Or will you be chasing after the assets of the home builder? Gas Leak. In the case of a gas leak from a gas station which caused harm to nearby businesses and landowners, the issue was whether an environmental or pollution exclusion clause was in effect. That is, did the insurer of the offending gas station have to respond to the lawsuit? Or was the gas station without insurance coverage, due to the nature of the gas leak? Ontario's Auto Insurance is Unique Insurance Coverage
Auto insurance is ingrained as part of our lifestyle and expectations.
It is interesting, however, to consider the unique type of insurance which is represented by our auto insurance scheme.
The fact that a parallel health care system is created, alongside our universal OHIP coverage, is one important aspect. This is the Accident Benefits system, which offers generally more insurance coverage that OHIP.
